Az Emberi Jogok Európai Egyezménye

Az Európa Tanács, megalakulásától kezdve nagy jelentőséget tulajdonított az emberi jogok tiszteletben tartásának. Azok az európai államok, amelyek az Európa Tanács szervezetéhez csatlakoztak, állást foglaltak egy közös eszmény megvalósítása
mellett, azaz; hogy országaik gazdasági és szociális fejlődését előmozdítva, a
jogállamiság alapelveit elfogadva, minden - a joghatóságuk alatt élő - személy számára
biztosítják az emberi jogokat és az alapvető
szabadságjogokat.

Legyen az gyermek, hontantalan vagy fogyatékkal élő:
- nem térhet el az állam azon kötelezettségétől, hogy a kínzástól, a kegyetlenségtől megvédje a területén tartózkodó személyeket.

Az ENSZ megalakulásától kezdve, egymás után fektették le az államok
nemzetközi közösségének alapnormáit és a békés egymás mellett élés szabályait,
megalkotva a polgári és politikai ill. gazdasági, szociális jogok átfogó egyezményeit.
A különböző emberi jogi egyezményeknek – pl. EGYEZMÉNY
a kínzás és más kegyetlen, embertelen vagy megalázó büntetések vagy
bánásmódok ellen. Ennek ellenére Magyarországon olyan kegyetlen és embertelen büntetésfajtákat, bánásmódokat alkalmaznak, amelyek egyértelműen a kínzás, az embertelen és megalázó bánásmód tilalma témakörébe tartoznak.
A mindent átható büntetlenségi kultúra a kínzási ügyekben Magyarországon kialakította és lehetővé teszi a helyi hatóságok számára, hogy bármiféle ellenőrzés nélkül kínozhasson meg embereket.

Annak ellenére, hogy az ország ratifikálta a két kulcsfontosságú kínzás elleni
nemzetközi egyezményt, / EGYEZMÉNY a kínzás és más kegyetlen, embertelen vagy megalázó büntetések vagy
bánásmódok ellen
- a Kínzás és más kegyetlen, embertelen és megalázó bánásmódról és büntetésről szóló 1984. évi egyezmény fakultatív jegyzőkönyvét (Optional Protocol to the Convention Against Torture, OPCAT) /
 az állami dolgozók továbbra is használnak olyan kínzásnak minősülő módszereket amivel családokat vonnak meg az alapvető emberi jogoktól.

Az Emberi Jogok Európai Bírósága legújabb ítélkezési gyakorlatában egyre hangsúlyosabb szerepet töltenek be azok az ügyel, amelyekben az Emberi Jogok Európai Egyezménye 3. cikkében foglalt kínzás, embertelen vagy megalázó bánásmód tilalmát sorozatban megsértik.
Az emberi jogok európai őrének új fegyvere: a pilot ítélkezés eljárása. A strasbourgi bíróság gyakorlatában a rendszerszintű, súlyos emberi jogsértésekre hívja fel a figyelmet. A Pilot ítélet, illetve ítéletek feltárják, a kormány hogyan és miért mulasztja el a kínzás tilalmára vonatkozó jogszabályok kikényszerítését.

Az Emberi Jogok Védelmezők Kör egy civil kezdeményezés, akiknek az elsődleges feladata segíteni a kínzás áldozatainak, hogy azok jogorvoslatot kaphassak, illetve hogy segítség elő a büntetlenségi kultúra felszámolását.

Magyarország jelentős kárt okoz magának a társadalomnak, az ország területén élő közösségeknek, bár a nemzetközi diplomáciában példaértékű eredményt ért el az emberi jogi egyezmények aláírása terén, azonban a kínzás erőteljes üldözésének hiányában azt kockáztatja, hogy ezek az emberi jogi kötelezettségvállalások üres ígéretekké vállnak.

A kormány elherdálja azt a lehetőséget is, hogy az emberi jogok iránti elkötelezettség ragyogó példája lehessen. 2012 óta az Emberi Jogok Védelmezők Kör keretei között zajló részletes kutatáson alapul adatbázis, amely több ezer kínzás áldozatául esett személy embertelen tanúvallomását, történetét dolgozza fel, arra hívja fel az emberi jogok védelmezőinek figyelmét, hogy az áldozatok között gyermekek is áldozatul esnek.

Az áldozatok gyermekként képtelen segítség nélkül jogorvoslatot kapni egy olyan országban, ahol még a felnőtt, legfelkészültebb jogász csapattal védelmezett, kimagasló anyagi javakkal rendelkező személy részére sem biztosított a
a kínzástól, a kegyetlenségtől a védelem.
Összehangolt erőfeszítésre van szükség a kínzás, valamint az azt elkövetők büntetlenségét biztosító kultúra eltörlése érdekében. Ezt hatékony megelőzéssel kell kezdeni, és ahol ez nem vezet sikerre, ott alapos vizsgálatra és a büntető eljárás szigorú lefolytatására, valamint a panaszok kivizsgálásának független rendszerére van szükség annak biztosítása érdekében, hogy senki se állhasson a törvények felett.

Kérem szépen, ha Ön az emberi jogok védelmezője segítsen abban, hogy a kínzás áldozatai mielőbb jogorvoslatot kaphassanak. Emberi Jogok Védelmezők Kör kifejlesztett és elkészített egy keretrendszert, ami tartalmazza a megkínzott áldozatok ügyeit, (természetesen név nélkül, külön figyelemmel a Isztambul Protokoll A kínzás vagy más kegyetlen, embertelen vagy megalázó bánásmód vagy
büntetés eredményes kivizsgálásáról és dokumentálásáról szóló kézikönyvre
), az esetek feltárása ezután segíthet a bíróságnak, az ügyészégnek, a rendőrségnek és az egészségügyben dolgozó szakembereknek, hogy a civilekkel, az emberi jogok védelmezőivel közösen elősegíthessük az áldozatok jogorvoslati jogait.

A fórumot az áldozatok védelme ügyében, a kínzás büntetlenségét biztosító kultúra eltörlésére indította
