The Hintalovon Children’s Rights Foundation was contacted by a parent asking for help to clarify which legal regulation applies to situations when a grandparent shares pictures of a child on social media without the parents’ permission (but with the permission of the minor child).

Act V of the 2013 Civil Act Code makes the parent responsible and entitled to decide if a photo, video or audio clip of their child can or cannot be shared. In all cases, the child’s opinion and safety should also be taken into account.

If a grandparent or family friend wishes to publish a picture of the child, the parent’s permission is required. In the absence of this permission, legal proceedings can be initiated against the posting adult.
