The Terre des hommes-Moldova concept paper “The child who commits criminal acts being under the age of criminal liability: premises for regulating its status” examines the current way of regulating the protection of a child who has committed a criminal offense and is not criminally liable in the Republic of Moldova. It highlights the systemic problems of the given field and the lacunar aspects of the legislation in force, which do not allow practical and efficient interventions according to the child's best interests. It also analyzes the situation of juvenile delinquency and existent trends in the Republic of Moldova in the light of the statistical data from the last 15 years. The focus of the policy brief is the development of concrete recommendations for improving the current situation. Thus, it comes with a legislative proposal, which is launched for discussion and debates, and which could become a legislative initiative in short term, should it find the support of the relevant actors.
This is a component of the advocacy activity carried out by Terre des hommes Moldova within the regional initiative "The Child Protection Hub in South-Eastern Europe", which aims to promote and continuously improve the child protection practices and policies in South-Eastern Europe through a participatory approach.
